General Terms and Conditions
1 Scope of application
These General Terms and Conditions apply to all legal relationships between the Hotel Bergfreund and the GUEST.
2 Conclusion of contract
Upon receipt of the written, telephone, electronic or personal booking and delivery of the booking confirmation, a contract is concluded between the GUEST and the Hotel Bergfreund. These General Terms and Conditions form an integral part of this contract. Notifications by e-mail are deemed to have been made in writing.
3. booking conditions
For all bookings, including those made via the Internet, valid credit card details must be provided as a guarantee. If these conditions are not met, Hotel Bergfreund may cancel the booking without notice.
Clause 4 below applies with regard to cancellation costs.
4 Cancellations and rebookings
4.1 General conditions
Cancellations or rebookings are only valid if they are sent to the Hotel Bergfreund in writing and confirmed by the hotel in writing. The following deadlines apply:
Changes/cancellations: Summer: 3 days / Winter: 2 days: before arrival are free of charge, if canceled later, cancellation fees of 100% of the booking amount apply.
Exception 20.12.-07.01. of each year 30 days prior to arrival are free of charge, if canceled later, cancellation fees of 100% of the booking amount apply.
Exceptions are possible by written agreement.
For bookings via reservation portals, the conditions stated in the online booking portals apply. By booking through these portals, the guest accepts these conditions.
4.1.1 Deposits
Deposits already paid will be refunded.
4.1.2 Separate regulations (e.g. for group bookings)
These can be agreed, but must be in writing.
4.2 Cancellation date and insurance
The date on which the written declaration is received by the booking office is decisive for calculating the cancellation date.
In cases of hardship, the cancellation costs may be covered by cancellation insurance, provided that the GUEST has taken out such insurance.
4.3 Provision of a substitute person
If the booked arrangement cannot be commenced, the Hotel Bergfreund will accept a replacement person who will take over the existing booking under the same conditions. The replacement person must be notified to the Hotel Bergfreund in good time (prior to arrival). The original GUEST remains the contractual partner and is liable.
4.4 Cancellation in the event of force majeure
In the event of force majeure such as political unrest, strikes, disasters, etc., the Hotel Bergfreund may cancel at short notice for safety reasons. In such cases, the GUEST will be refunded the amount paid.
4.5 Disruptions and operating restrictions
Disruptions such as noise and/or operating restrictions do not entitle the guest to any compensation or refund.
5 Price changes Hotel Bergfreund may change the advertised prices in the following cases:
clearly explainable printing or typing errors
exchange rate changes (converted according to the daily exchange rate of the Hotel Bergfreud)
newly introduced or increased government charges (e.g. VAT, visitor’s tax, etc.)
If the prices for the booked service change after conclusion of the contract (for reasons other than those mentioned above), this is irrelevant for the concluded contract, regardless of the direction in which the price development has taken place.
6. liability for damages and liability
The Hotel Bergfreund is only liable for damages in cases of intent or gross negligence. Liability for items brought into the hotel is excluded to the extent permitted by law. Claims must be made in writing to the Hotel Bergfreund immediately, at the latest 3 days after departure; otherwise the claims shall be deemed forfeited.

Service booker (hereinafter referred to as GUEST)
7. use of the hotel room
The hotel room must be used and treated with the utmost care by the GUEST. It may only be used or occupied by the number of persons (including children) specified in the contract. The GUEST is not permitted to allow third parties to use rented hotel rooms in the Hotel Bergfreund.
The GUEST is liable for any damage unless he can prove that this was caused through no fault of his own (or that of other users). Damage must be reported to the hotel immediately.
8. room check-in and check-out
Unless expressly agreed otherwise between the contracting parties, the earliest room check-in is possible from 14:00 on the day of arrival and the latest room check-out is possible until 10:30 on the day of departure.
9. data protection
Hotel Bergfreund undertakes to comply with the applicable data protection legislation when handling and processing all customer data and customer usage data. Customer data will only be used to maximize operational safety or in the interests of sales promotion, product design, crime prevention, collection of key economic data and statistics and invoicing. The GUEST hereby acknowledges and agrees that in cases of joint provision of services in cooperation with third parties, the Hotel Bergfreund is entitled to make customer data accessible to the third parties concerned to the extent that this is necessary in the interest of providing the services. Otherwise, the disclosure of customer data to third parties is only permitted with the express consent of the customer. An exception only applies if the Hotel Bergfreund is legally obliged to pass on personal data to third parties.
10 Applicable law and place of jurisdiction
Swiss law shall apply exclusively to all contracts concluded with the Hotel Bergfreund under these GTC. The exclusive place of jurisdiction for any disputes arising from such contracts is Brig/VS.
